Terms of Service
1. Introduction
Welcome to WearAttraction. These Terms of Service ("Terms") govern your access to and use of the websites, platforms, and services operated by ICONIKEDILHA - UNIPESSOAL LDA (NIPC 517613255), a company registered under Portuguese law with its registered office at Tv. Parreiras 70, R/C, 1150-299 Lisboa, Portugal, trading as WearAttraction ("we", "us", "our", "WearAttraction").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
2. Definitions
- "Services" means all websites, platforms, portals, and related services operated by WearAttraction, including but not limited to: the WearAttraction website (wearattraction.com), the WearAttraction business platform (business.wearattraction.com), the Customer Portal, NFC and QR code redirect services, and any associated mobile or web applications.
- "Customer Portal" means the authenticated area where registered users can view proposals, manage NFC chip configurations, and access analytics.
- "NFC Services" means the provisioning, configuration, and redirect services for NFC chips and QR codes supplied by WearAttraction, including tap analytics.
- "Proposal" means a commercial quote or offer prepared by WearAttraction for a customer, detailing products, quantities, branding specifications, and pricing.
- "User" or "you" means any individual or entity that accesses or uses the Services.
- "Account" means a registered user account on the Customer Portal.
- "Content" means any text, images, logos, designs, artwork, or other materials uploaded, submitted, or provided by Users through the Services.
3. Eligibility
3.1. You must be at least 16 years of age to create an Account or use our Services. By registering, you represent and warrant that you are at least 16 years old. If you are under 18, you represent that you have your parent's or legal guardian's consent to use the Services.
3.2. If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" refers to that entity.
3.3. WearAttraction sells products designed for all ages, including children's apparel. Purchases of children's products must be made by a parent or legal guardian who is at least 18 years of age. NFC-enabled children's products for children under 16 are managed exclusively through the parent's or guardian's Account.
4. Account Registration and Security
4.1. To access the Customer Portal, you must create an Account. Account creation may be initiated by WearAttraction on your behalf (e.g., when a proposal is created for you) or by you directly through our registration process.
4.2. We offer the following authentication methods:
- Email magic link — a one-time login link sent to your email address;
- Social login — sign in with your Google, Microsoft, or LinkedIn account;
- WhatsApp OTP — a one-time code sent to your WhatsApp number (where available).
When you authenticate via a social login provider, we receive your name, email address, and profile photo from that provider. Your use of social login is also subject to the respective provider's terms and privacy policy. WearAttraction does not receive or store your social login password.
4.3. You are responsible for maintaining the security of the email address, phone number, and/or social login accounts associated with your Account.
4.4. You agree to:
- Provide accurate and complete information during registration;
- Keep your contact information up to date;
- Notify us immediately of any unauthorised access to your Account;
- Not share your authentication credentials or allow others to access your Account.
4.5. We reserve the right to suspend or terminate your Account if we reasonably believe that your account information is inaccurate, that your Account has been compromised, or that you have violated these Terms.
4.6. Company Accounts (B2B)
Where you use the Services on behalf of a company or organisation ("Company"), the following additional terms apply:
4.6.1. Company Account: A Company Account is created when a company engages with WearAttraction for B2B services. Proposals, orders, NFC chips, and associated analytics are linked to the Company Account, not to individual user accounts.
4.6.2. Company Administrator: The first user associated with a Company Account, or a user designated by WearAttraction, is the Company Administrator. The Company Administrator may:
- Invite or remove team members from the Company Account;
- Assign roles and permissions to team members (e.g., admin, member, viewer);
- Access all proposals, NFC analytics, and order history associated with the Company;
- Transfer the Company Administrator role to another team member.
4.6.3. Team Members: Users invited to a Company Account by the Company Administrator have access to Company data according to the permissions assigned to them. Team members authenticate with their own individual credentials.
4.6.4. Ownership of Data: All proposals, orders, NFC configurations, and analytics associated with a Company Account belong to the Company, not to individual users. When a team member leaves the Company or is removed from the Company Account, their access to Company data is revoked, but Company data is retained.
4.6.5. Responsibility: The Company (through its Company Administrator) is responsible for managing team member access and ensuring that only authorised individuals have access to the Company Account. WearAttraction is not liable for actions taken by team members who were granted access by the Company Administrator.
5. Services Description
5.1. B2B Branded Merchandise
WearAttraction provides branded merchandise and apparel services to businesses, including product sourcing, branding (embroidery, print, NFC embedding, etc.), and fulfilment. All B2B orders are made-to-order. We do not hold finished goods in stock.
5.2. Online Store
WearAttraction operates an online store at wearattraction.com where consumer products may be purchased directly.
5.3. Customer Portal
Registered users can access the Customer Portal to:
- View and manage commercial proposals;
- Configure NFC chip and QR code redirect destinations;
- View NFC tap analytics (tap counts, device types, country of origin);
- Manage account settings and communication preferences.
5.4. NFC and QR Code Services
WearAttraction provides NFC chips and QR codes that redirect to configurable destinations. Each chip/code is assigned a unique identifier and points to a WearAttraction-managed redirect URL (e.g., waqr.eu). The redirect destination is configurable by the Account holder through the Customer Portal. WearAttraction logs basic analytics data for each tap/scan event (see our Privacy Policy for details).
5.5. Newsletter and Communications
You may subscribe to receive updates, news, and marketing communications from WearAttraction. Subscription is voluntary and requires explicit opt-in with email confirmation (double opt-in). You may unsubscribe at any time using the link provided in each communication.
6. Proposals and Orders
6.1. Proposals
Proposals prepared by WearAttraction are invitations to treat and do not constitute binding offers unless expressly stated otherwise. Proposals are valid for the period stated therein, or for 30 days from the date of issue if no validity period is specified.
6.2. Order Acceptance
A binding contract is formed only when WearAttraction sends written confirmation of acceptance of your order (by email, WhatsApp, or through the Customer Portal). WearAttraction reserves the right to decline any order.
6.3. Pricing
All prices in proposals are quoted in Euros (EUR) unless otherwise stated. Prices exclude VAT unless explicitly stated to include VAT. WearAttraction reserves the right to adjust pricing in the event of material changes in supplier costs, provided that any such adjustment is communicated to you before order confirmation.
6.4. Payment Terms
Payment terms are specified in each proposal. Unless otherwise agreed:
- Payment is due within the timeframe specified in the proposal;
- Late payments may incur interest at the rate permitted under Portuguese law (currently the ECB reference rate plus 8 percentage points for commercial transactions, per Decree-Law 62/2013);
- WearAttraction reserves the right to withhold delivery until full payment is received.
6.5. Delivery
Estimated delivery times are provided in good faith but are not guaranteed. Standard turnaround is 10-15 working days from order confirmation. WearAttraction shall not be liable for delays caused by circumstances beyond our reasonable control.
6.6. Cancellations and Returns
Due to the made-to-order nature of B2B branded merchandise, orders cannot be cancelled once production has commenced. For consumer purchases through the online store, your statutory rights under Portuguese and EU consumer protection law (including the 14-day withdrawal right under Decree-Law 24/2014) apply.
7. Intellectual Property
7.1. WearAttraction IP
All intellectual property rights in the Services, including but not limited to the WearAttraction brand, logos, website design, software, and documentation, are owned by or licensed to ICONIKEDILHA - UNIPESSOAL LDA. Nothing in these Terms grants you any rights in our intellectual property except as expressly set out herein.
7.2. Your Content
You retain ownership of any Content you provide to us (logos, artwork, designs, etc.). By submitting Content, you grant WearAttraction a non-exclusive, worldwide, royalty-free licence to use, reproduce, and modify such Content solely for the purpose of fulfilling your orders and providing the Services.
7.3. Your Warranty on Content
You represent and warrant that:
- You own or have the necessary rights and licences to the Content you provide;
- Your Content does not infringe any third party's intellectual property rights, privacy rights, or other legal rights;
- Your Content does not contain any unlawful, defamatory, obscene, or otherwise objectionable material.
You shall indemnify WearAttraction against any claims, damages, or expenses arising from a breach of this warranty.
8. NFC Services — Specific Terms
8.1. NFC Ownership and Management Rights
NFC chips and QR codes are managed through the WearAttraction platform. Ownership and management rights depend on how the product was purchased:
8.1.1. Consumer purchases (B2C): When you purchase an NFC-enabled product directly from WearAttraction (e.g., through our online store), you are both the Owner and Manager of the NFC chip. You have full control over the redirect destination and access to tap analytics.
8.1.2. Company purchases (B2B): When a Company purchases NFC-enabled products for its employees, customers, or events, the Company is the Owner of all NFC chips associated with that order. The Company Administrator controls:
- The default redirect destination for all chips;
- Whether individual end users (e.g., employees) are granted management rights to their assigned chip;
- Access to tap analytics for all chips owned by the Company.
8.1.3. Delegated management: A Company Administrator may grant an end user (e.g., an employee) management rights to a specific NFC chip. A delegated user may:
- Change the redirect destination for their assigned chip;
- View tap analytics for their assigned chip only.
The Company Administrator may revoke delegated management rights at any time. Upon revocation, the chip reverts to the Company's default configuration. The end user's personal data associated with the chip (e.g., a personal vCard or profile URL they configured) is removed from the chip configuration upon revocation.
8.1.4. Employee departure or access revocation: When a delegated user's access is revoked (e.g., employee leaves the Company), the Company Administrator retains full ownership and control of the NFC chip. The chip can be reassigned or reconfigured. The former user loses all access to the chip and its analytics.
8.2. Redirect Configuration
You may configure the redirect destination for NFC chips and QR codes that you own or have been granted management rights to, through the Customer Portal. You are solely responsible for the content and legality of the destination URLs you configure.
8.3. Prohibited Destinations
You must not configure NFC chips or QR codes to redirect to content that:
- Is unlawful, harmful, threatening, abusive, defamatory, or obscene;
- Infringes any intellectual property rights;
- Contains malware, phishing attempts, or other malicious content;
- Violates any applicable law or regulation;
- Impersonates any person or entity.
WearAttraction reserves the right to disable any redirect that violates these Terms, with or without prior notice.
8.4. Tap Analytics
WearAttraction collects anonymised analytics data for each NFC tap or QR scan event (timestamp, device type, country). This data is made available through the Customer Portal to:
- B2C chip owners: Full analytics for their own chips;
- Company Administrators: Analytics for all chips owned by the Company;
- Delegated users: Analytics for their assigned chip(s) only.

8.5. Service Availability
WearAttraction endeavours to maintain the NFC redirect service with high availability, but does not guarantee uninterrupted service. We shall not be liable for any temporary unavailability of the redirect service.
9. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose;
- Attempt to gain unauthorised access to any part of the Services;
- Interfere with or disrupt the Services or servers;
- Use automated tools to scrape, crawl, or extract data from the Services;
- Upload viruses, malware, or other harmful code;
- Impersonate any person or entity;
- Use the Services to send unsolicited communications (spam);
- Circumvent any technical measures we use to provide the Services.
10. Disclaimer of Warranties
10.1. The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law.
10.2. WearAttraction does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.
10.3. Product colours may vary from on-screen representations due to differences in display settings and manufacturing processes.
10.4. Where WearAttraction provides product information regarding sustainability certifications (e.g., OEKO-TEX, organic, vegan), such information is based on data provided by our suppliers. WearAttraction does not independently verify these certifications and shall not be liable for inaccuracies in supplier-provided certification data.
11. Limitation of Liability
11.1. To the maximum extent permitted by applicable law, WearAttraction's total aggregate liability arising out of or in connection with these Terms or the Services shall not exceed the greater of: (a) the total amounts paid by you to WearAttraction in the 12 months preceding the event giving rise to the liability; or (b) EUR 100.
11.2. In no event shall WearAttraction be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, even if we have been advised of the possibility of such damages.
11.3. Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless WearAttraction, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Services; (b) your breach of these Terms; (c) your Content; or (d) your violation of any applicable law or third-party rights.
13. Suspension and Termination
13.1. By You: You may close your Account at any time by contacting us. Closure of your Account will result in the deactivation of your NFC chip and QR code configurations.
13.2. By WearAttraction: We may suspend or terminate your access to the Services, in whole or in part, at any time, with or without cause, with or without notice. We will endeavour to provide reasonable notice where practicable.
13.3. Effect of Termination: Upon termination: (a) your right to use the Services ceases immediately; (b) NFC chips and QR codes associated with your Account will cease redirecting to your configured destinations; (c) you may request export of your data in accordance with our Privacy Policy.
13.4. Sections 7 (Intellectual Property), 10 (Disclaimer), 11 (Limitation of Liability), 12 (Indemnification), and 15 (Governing Law) shall survive termination.
14. Force Majeure
WearAttraction shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, strikes, government actions, supplier failures, power outages, or internet disruptions.
15. Governing Law and Dispute Resolution
15.1. These Terms shall be governed by and construed in accordance with the laws of Portugal.
15.2. For consumers resident in the EU, nothing in these Terms affects your statutory rights under the consumer protection laws of your country of residence.
15.3. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Lisboa, Portugal, except where mandatory consumer protection laws provide otherwise.
15.4. In accordance with Regulation (EU) 524/2013, consumers may use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
16. Changes to These Terms
16.1. WearAttraction reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and, where practicable, by email.
16.2. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services and close your Account.
17. Miscellaneous
17.1. Entire Agreement: These Terms, together with our Privacy Policy and any applicable Proposal or order confirmation, constitute the entire agreement between you and WearAttraction regarding the Services.
17.2. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
17.3. No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
17.4. Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. WearAttraction may assign its rights and obligations without restriction.
17.5. Language: These Terms are available in English and Portuguese. In the event of any conflict between the language versions, the Portuguese version shall prevail.
